Terms of Service

1. Acceptance of Terms

By accessing or using PixelGust ("the Service"), operated by PixelGust ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

PixelGust provides weather, climate, terrain, environmental, and hazard analysis data through a web-based dashboard and REST API. The Service includes free and paid tiers with varying feature access and usage limits.

3. Accounts

To access certain features you must create an account via Google Sign-In or email authentication. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Subscriptions & Payments

Paid subscriptions are billed monthly or annually through our payment processor, Lemon Squeezy. By subscribing, you agree to:

• Pay the fees associated with your selected plan
• Automatic renewal unless cancelled before the billing cycle ends
• Pricing changes with at least 30 days' notice via email

You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access until the end of your current billing period.

5. Refund Policy

We offer a full refund within 14 days of your initial subscription purchase, no questions asked. Refunds for annual plans are prorated after the 14-day window. Contact us at support@pixelgust.com to request a refund.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Circumvent usage limits, rate limits, or access controls
• Redistribute or resell data obtained from the Service without permission
• Use automated systems to access the Service beyond the provided API
• Interfere with the Service's infrastructure or other users' access

7. API Usage

API access is subject to rate limits defined by your subscription tier. Exceeding these limits may result in temporary throttling or suspension. API keys are personal and must not be shared publicly.

8. Data Accuracy & Disclaimer

PixelGust aggregates data from multiple public sources including NOAA GFS, ERA5, MODIS, and OpenStreetMap. While we strive for accuracy:

• Data is provided "as-is" without warranties of completeness or accuracy
• The Service should not be used as the sole basis for safety-critical decisions (e.g., emergency evacuations, aviation)
• We are not liable for decisions made based on data from the Service

9. Intellectual Property

The PixelGust platform, including its design, code, and documentation, is our intellectual property. You retain ownership of any data you upload or generate through the Service. We do not claim rights over your exported reports or API query results.

10. Limitation of Liability

To the maximum extent permitted by law, PixelGust shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months prior to the event giving rise to the claim.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with notice where practicable. You may delete your account at any time by contacting support@pixelgust.com.

12. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the European Union and the Hellenic Republic (Greece). Any disputes shall be resolved in the courts of Athens, Greece.
